This is a legal agreement between you and nucleustar limited, a company registered in England and Wales, company number 05677318, registered office Suite 72, Cariocca Business Park, 2 Sawley Road, Manchester, M40 8BB, England (‘nucleustar’,‘we’,‘us’,‘our’). Dating Clarity is a trading name of nucleustar.

The purpose of this agreement is to set out your and our rights and obligations for the use of the Dating Clarity web site service (‘the service’).

By accessing the service you are agreeing to be legally bound by these terms.

You should take time to read these terms carefully and if you are in disagreement with any part, stop using the service immediately.

1. Your Obligations
   
   
   1. You agree to use the service only for purposes that are lawful within the United Kingdom of Great Britain and Northern Ireland as well as your local jurisdiction from where you access the service.
      
      
   2. You agree that you will not submit any personal information regarding yourself unless you are 18 years of age or over.
      
      
   3. You agree to use the service in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the service.
      
      Prohibited behaviour includes:
      
      
      • Harassing or causing distress or inconvenience to any person.
      • Transmitting, publishing or storing obscene or offensive content.
      • Transmitting, publishing or storing content intended to incite racial, sexual or religious intolerance and/or hatred.
      • False statements intended to deceive any person with the intention of committing a criminal offence.
      
      
   4. You are solely and legally responsible for the content that you transmit, publish or store using the service.
      
      You must not:
      
      
      • Make defamatory statements concerning any person or persons.
      • Transmit, publish or store any content or material unless you own the intellectual property rights for that content or material, or have been given the relevant explicit permission/s from the owner of the intellectual property rights for that content or material.
      
      You agree that you will reimburse us for any costs incurred by us as a result of any breaches as stated above.
      
      
   5. You agree that any personal data that you submit to the service can be made freely available, subject to our privacy statement and your legal rights as defined by the laws of the United Kingdom of Great Britain and Northern Ireland.
      
      
   6. You agree that all content and material that you submit to the service becomes the intellectual property of nucleustar.
      
      
   7. You agree to not re-produce any of the content of the service except for personal and non-commercial purposes. nucleustar are the copyright and dataright owners of all content of the service.
      
      
   8. You agree that this agreement shall be governed by the laws of England and Wales and that you and us hereby submit to the jurisdiction of the courts of England and Wales.
      
      
2. Our Obligations and Your Rights
   
   
   1. By providing the service we are acting as a web hosting service.
      
      
   2. We will ensure that any defamatory content or material, or content or material that is stored on the service without the intellectual property owner’s permission, is removed from the service as soon as we are advised and reasonably able to carry out investigations and remove content or material as appropriate.
      
      
   3. Under no circumstances will we be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise):
      
      
      • Loss of data.
      • Loss of revenue or anticipated profits.
      • Loss of business.
      • Loss of opportunity.
      • Loss of goodwill or injury to reputation.
      • Losses suffered by third parties.
      • Any indirect, consequential, special or exemplary damages arising from the use of the service.
      
      
   4. We do not warrant that functions of the service will be uninterrupted or error free, or that defects will be corrected.
      
      
   5. The service is free to use and open to all persons, subject to clauses 1.1 to 1.8.
      
      
   6. We reserve the right to alter, remove or transfer to new ownership any part or all of the service without providing any notice.
      
      
   7. We reserve the right to provide any information submitted to the service to any law enforcement agencies, as we are required to do so by the laws of the United Kingdom of Great Britain and Northern Ireland.
      
      
   8. We will comply fully with the service’s published privacy statement and register the service as we are legally required to do.
      
      
   9. We reserve the right, without prior notice, to prohibit the use of the service, to any person that we believe breaches any of the terms in clauses 1.1 to 1.9.
      
      
   10. We reserve the right to completely remove any personal profile. We will ensure that any requests to remove personal information are processed within 60 days from when we received the request.
